The first technical regulation in history of the RF was approved in 2005 and it dealt with safety of emission from vehicles. The second regulation was developed 3 years later. For the time being there are up to 20 RF technical regulations in use that set procedure for safety circulation of tobacco products, fish, household products, feed additives etc.
Technical regulations are regulatory documents of specific purposes. Procedure of its development is subject to Federal law “On technical regulation” in which a definition of technical regulation is given. It is a document that sets requirements covering different objects of technical regulation, i.e. products, buildings and constructions, processes of storage, usage, transportation, selling the goods etc. As the document can be approved by international contract ratified in the RF, President’s decrees, federal laws its requirements are mandatory for fulfilment.
Requirements for the regulated objects constitute the greatest part of each technical regulation. Primarily they ensure safety of life and property of the RF citizens, preservation of property of enterprises of different ownership, protection of environment, plant and animal life. Another not less important role of the RF technical regulations is to ensure that consumers have trustworthy information that prevents them from being deceived.
Technical regulations contain minimal requirements. If the product fails to meet them, then it potentially threatens life, health and/or property of the user. The RF TRs list requirements for biological, mechanical, industrial, fire, thermal, chemical, radiation, electrical, nuclear and explosion safety. In addition, technical regulations describe requirements for the unity of measurements.
Developers of the RF technical regulations have an aim to include as full as possible list of requirements into the documents because requirements that are not in the regulations are of voluntary nature.
Technical regulations are effective only inside Russia. After the formation of the Customs Union in 2010, there appeared a notion of Customs Union technical regulation. This document fulfils the same tasks as the RF technical regulation and includes the same mandatory sections: scope of application, definitions, safety requirements, compliance assessment, unified marking.
Gradually with phasing in the Customs Union technical regulations that have wider scope of application, the RF technical regulations are becoming null and void.
Considering that today two types of technical regulations are in effect in the RF, compliance assessment can be done according to the RF technical regulation requirements or the CU technical regulations requirements. Compliance check procedure is standard for both cases: submitting of application form, collecting the documents, carrying out tests and other stages required by different certification and declaration schemes. The choice of technical regulation depends on the sphere of application to which belongs the goods.
A considerable difference between compliance documents is that certificates (declarations) of the CU TRs are accepted in all member-states of the Customs Union and that of the RF TRs – only in Russia.
